United States Attorney Brendan V. Johnson announced that Adam Poor Bear, age 22, of Parmelee, appeared before United States District Judge Roberto A. Lange on May 1, 2012, and pled guilty to an indictment that charged him with Assault with a Dangerous Weapon. The maximum penalty upon conviction is 10 years in custody, a $250,000 fine, or both.
The conviction stems from an incident that took place on July 21, 2011, in Parmelee, South Dakota. Poor Bear and the victim were together when Poor Bear pulled an air pistol out of his clothing and pushed the barrel of the pistol against the victim's forehead, indicating he was going to shoot the victim. The weapon was capable of causing bodily injury. The investigation was conducted by Rosebud Sioux Tribe Law Enforcement Services. The case is being prosecuted by Assistant United States Attorney Tim Maher.
A presentence investigation was ordered, and a sentencing date was set for July 16, 2012. The defendant was remanded to the custody of the United States Marshal pending sentencing.
